Actually after two days of banging on this issue I have reached two 
resolutions.  

1. Flashing to latest firmware (3.08.00.016) seems to have solved it.

2. If you cannot flash firmware, you can use 2.6.16.38 kernel from Xen 
3.0.4.  I tried this kernel with Xen 3.1.3-rc2 and it works.

Sounds a bit strange to me, but nice if it helps for you...
I have a 9500S-12 and the latest firmware is 2.08.00.009 - which is flashed
on my controller already.

That''s right, 2.6.16 on 3.0.4 works very well. I wouldn''t call
it "solution", but it''s a nice workarround, until someone
cute fixes this
problem.
