I might be wrong but looking at alloc_skb_with_frags(), it returns 
-ENOBUFS actually:

 ??? *errcode = -ENOBUFS;
 ??? skb = alloc_skb(header_len, gfp_mask);
 ??? if (!skb)
 ??? ??? return NULL;
