times difference causes write
Using rsync-2.4.6:
Is a times difference supposed to cause a write?
Also -t vs -I makes no difference.
Below shows the problem, I think:
[dmahurin@pc16 /tmp]$ mkdir x y
[dmahurin@pc16 /tmp]$ cp /bin/ls x
[dmahurin@pc16 /tmp]$ ls -l x/ls
-rwxr-xr-x 1 dmahurin users 43024 Nov 13 12:46 x/ls
[dmahurin@pc16 /tmp]$ rsync -vrtW x/ y
building file list ... done
./
ls
./

direct write patch
I have attached a patch that supports a new "--direct-write" option.
The result of using this option is to write directly to the destination
files, instead of a temporary file first.
The reason this patch is needed is for rsyncing to a device where the
device is full or nearly full.
Say that I am writing to a device that has 1 Meg free, and a 2 meg file
on that device is out of date.

patch - forceshell
Attached is a simple patch which allows an auth param 'shell=' like
'command='
When specified, sshd will use this shell instead of the one in
/etc/passwd or the default shell.
This patch allows you can have some chrooted shell (actually any shell)
associated with a specific key.
You could do this with command=, but then the command given to ssh will
be ignored, and scp will not
