If my swiss cheese memory serves me correctly, Madonna sued someone who registered madonna.com even though "madonna" is a real word, but the site had nothing to do with it and was "obviously" taking advantage of the popularity of her name. This seems to be the case here, as well. Look at the case of Nissan Motors versus Nissan Computers. Uri Nissan had the name before the car company (as it is his last name) and they successfully sued and now they "share" the name. Perhaps you could "convince" them that a long drawn out lawsuit would not be in their best intersted and that they should give up the name for a nominal fee.
