I see the problem, the josefsson proposal is nice.

The draft aren't covered still I don't have any problems in using
Josefsson's proposed boilerplate.

the IETF drafts had to be removed from the Debian package recently because
IETF RFCs/drafts are (per default) not conformant to the Debian Free Software
Guidelines, see

It would be nice if Phil and Luca could dual-license the drafts under a
DFSG-free license also ... most straight-forward would be libtheora's own
license (COPYING). Another suggestion is Simon Josefsson's update to BCP79,
see <URL:http://josefsson.org/bcp78broken/>.

Maybe the drafts are already meant to be covered by libtheora's COPYING
file,
but I couldn't find any statements to that effect.
