Commercial use and distribution of Theora codec?

I know that Theora is marketed as patent-free and free to use for any purpose, but a fellow over at Xvid.com told me that Theora in fact is based on MPEG tech, and therefore has some deep elements that people might eventually go after me for if I use it to encode commercially distributed video, and bundle the decode files with the game. patch to build theora-mmx on AMD64
Hi all, I've patched theora-mmx to build on x86_64. The patch against SVN is attached. Basically all I did was to copy lib/i386 to lib/x86_64 and tweak the assembler code a bit: * added to each file: typedef unsigned long int ogg_uint64_t * converted all asm inputs to 64-bit in: dsp_mmxext.c, fdct_mmx.c, recon_mmx.c * left all asm outputs at 32-bit * I didn't patch dsp_mmx.c, since all

I did a quick test integration of theora into our engine and ran into a couple of issues listed below. .dsp files in the alpha 3 zip are in unix format. Additional include path for the static theora library project is wrong. Library relies on libogg - would be nice to have a single zip including all dependencies. dumpvideo sample relies on global structures being zero initialized though does

Theora got extreamly slow (Makefile.am was changed)
I have tried to add a plunging to the "libtheora-1.0beta2" (network bandwidth measuring component was added) and Got it success for some far now the problem is when it is added the encoding process get extremely slow (around 20 seconds delay).
